The Legacy Partner Program
Welcome to The Legacy Partner Program (Affiliate Program by Malkans Training Institute Pvt Ltd. By signing up as an affiliate, you agree to the following Terms & Conditions, governed by Indian law. Please read carefully before participating.
1. Eligibility
• You must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• Your application may be rejected if your website, content, or marketing practices are deemed inappropriate, misleading, or harmful to our brand.
2. Enrollment
• Upon submitting your signup form, we will review and notify you of acceptance or rejection on your email submitted during the signup process.
• Our decision is final and may be reversed if we later discover non-compliance with these terms.
3. Affiliate Responsibilities
• You may promote our programs/ courses/ products through approved channels (blogs, websites, email marketing, social media, webinars, SMS and WhatsApp, etc.)
• You must not:
o Engage in spam, fake leads, or misleading advertisements.
o Make false claims about income, profits, or guarantees.
o Run paid ads bidding directly on our brand name or trademarks without prior written approval.
o Please note we do not encourage keywords which include shortcut money-making methods, Sharemarket Tips, Stock Tips, etc
• You must comply with all Indian laws, including but not limited to:
o Information Technology Act, 2000 (regarding digital promotions).
o Consumer Protection Act, 2019 (no deceptive marketing).
o GST Act, 2017 (if applicable).
*The perks and benefits can only be claimed on the successful given number of sales. Commission payouts will be made only after full and final payment is received from your referral.
• A sale qualifies only if:
o It is tracked by our affiliate system.
o It is not canceled, refunded, or marked fraudulent.
• Payments:
o Commission payouts will be made only after Full & Final payment done by your referral.
o Minimum payout threshold: Rs 2,50,000
o Payments will be made via Bank Transfer/NEFT/IMPS (no cash payments).
• Taxation:
o Commissions are subject to TDS (Tax Deducted at Source) under the Income Tax Act, 1961.
o Affiliates registered under GST must provide a valid GSTIN and invoice to claim GST.
o If GST is applicable, commission payouts will be made inclusive of GST, subject to invoice submission.
5. Termination
• We reserve the right to suspend or terminate your affiliate account at any time if:
o You violate these Terms & Conditions.
o You engage in fraudulent or illegal activities.
• Upon termination:
o Pending unpaid commissions on valid sales before termination will be freezed and only be release after due verification.
o You must immediately stop using our brand name, logos, and promotional materials.
6. Intellectual Property
• You are granted a limited, non-exclusive, revocable license to use our logos, banners, and promotional materials.
• You may not modify or misuse our intellectual property in any way.
• All rights remain with [Malkans Training Institute Pvt Ltd].
7. Limitation of Liability
• We are not responsible for indirect, incidental, or consequential damages arising from your participation.
• You agree to indemnify and hold harmless [Malkans Training Institute Pvt Ltd] against any claims arising out of your actions.
8. Modification of Terms
• We may update these Terms & Conditions at any time. Please refer to the last updated date and the version.
• Continued participation after changes constitutes acceptance of revised terms.
9. Governing Law & Jurisdiction
• The laws of India govern these Terms.
• Any disputes shall be subject to the exclusive jurisdiction of the courts of [Maharashtra, India].
